Credit Card Refunds

In the fight for a refund from a credit card company, one owner had this to say in a newsgroup... the names of the companies involved have been changed to prevent any libel on this web site.

We are claiming a c/c refund for our upgrade to XYZ in 1995. Payment was made in full in a single amount.

The first response has been to refuse the claim on the grounds that our contract was with ABC who were acting as agent for XYZ and that ABC had fulfilled their contract by collecting and passing on the money to XYZ.

We have now taken the following steps.

Spoke to the OFT who were sympathetic and suggested we write an official letter of complaint to them. It seems the OFT cannot deal with individual cases but will investigate companies where there are a number of complaints on similar matters. They told us to contact our local Trading Standards office.

Contacted the Trading Standards office who took the time to look into the matter and phoned back with the recommendation that we pursue our claim as they feel we have a good case. TS office posted me a copy of 'Equal Liability' Section 75 of the Consumer Credit Act 1974. They also suggested ways in which to reply to Barclaycard. In all they were very helpful.

We have answered Barclaycard by pointing out that ABC is part of the XYZ group and therefore there HAS been a breach of contract and misrepresentation. We are now waiting for their reply. Has anyone successfully claimed a refund for breach on contract or misrepresentation for anything relating to LBC where the c/c statement shows payment to ABC? I would love to know!
