Did You Buy A Timeshare that never got built? LBC2? If anyone wants to do the same as others have, try a letter to your credit card company that goes something like this:

"Dear Sir, I paid over funds for a timeshare which did not materialise and I am writing to ask for a refund. The transaction was for £**** and was a sum of money paid to upgrade my existing timeshare at the Lanzarote Beach club (phase 1) development to the Lanzarote Beach club (phase 2) which was to be built next door to the existing site. Lanzarote Beach club phase 2 has never been built. The vendor has over a period of years led people to believe that construction would begin in the near future, they even had a mock up of the new villas built inside the existing club house to show people round during the selling process. It is now widely accepted that LBC2 will never be built and this well known con has been reported about on the BBC. I would because of this like to claim back under section 75 of the consumer credit act the sum of £**** from yourselves.

I realise that it is more than 6 years since the transaction but would point out that LBC2 was still being sold up to spring 1999 and it was not until this point that it was clearly established that no construction would ever take place. Section 32.1 of the Limitation Act 1980 states that the limitation period in cases of fraud runs from the date when the fraud is discovered."

Holiday Clubs are BAD news and should be avoided says timeshare consumer association. With timeshare you should get a 10 day minimum (14 days in UK) cooling off period. During this cooling off period no deposit is permitted giving time for you to reconsider and abort. If they don't offer this, walk away. If you visit a presentation and are asked to sign on the spot- Don't, it is probably a club which gets around the usual timeshare laws and regulations.

If you are too late and you already have signed - Continue with the purchase and hope it is ok, or cancel within 10 days and ask your credit card company to refund under their voluntary code, and risk being taken to court by the holiday club or its agents. Talk to a solicitor.
